Jacky Ndala, former president of the youth party Ensemble pour la république, has been summoned to appear before the Kinshasa/Kinkole Peace Court on Tuesday, November 5. The summons, issued by the Democratic Republic of Congo, was sent to him on November 1, 2024. The Ensemble activist is accused of having made the following comments on social networks:
“A group of people came into my cell and asked me to put the mask back on, I refused and thought it was suspicious. They left and came back later to open the cell and brutalize me. To be honest, I didn’t understand what was going on that day. They beat me, they raped me, they sodomized me and in the morning I didn’t understand, in fact I didn’t realize, I don’t know if I was drugged or hypnotized; I woke up and didn’t understand what was going on. I was in a deplorable state, an incredible humiliation, I left my honor in that cell… but to my great surprise, it’s this lady who comes out in a video, making statements, bragging about being the sponsor of this action, having paid money to our security services to shame me. I don’t deserve this, I am obliged to break my silence, not for myself, but for many Congolese who may have been there, who don’t know how to face this reality…”.
In the Republic’s view, these statements are false and constitute the offense of spreading false rumors, causing enormous damage. The Republic therefore asks the Court to sentence the defendant to the maximum penalty provided by law and to pay damages in the amount of USD 1,000.
