The European Union has expressed its position on recent trials in the Democratic Republic of Congo in which defendants have been sentenced to death. This concerns in particular the case of Corneille Nangaa and his accomplices active in the AFC/M23 rebellion in the east of the country.
The European Union reiterates the need to ensure the right to a fair trial and respect for the rights of the accused, in accordance with the international obligations to which the DRC is a party.
It “reaffirms its total opposition to the death penalty in all circumstances.
“The death penalty is incompatible with the inalienable right to life and is cruel, inhuman and degrading. It represents the ultimate denial of human dignity, fails to deter criminal activity and makes miscarriages of justice irreversible. We have strongly expressed this view to all relevant interlocutors in the DRC, including recently in talks with various members of the government and senior officials in Kinshasa,” the EU said in a statement released on Friday, August 9, 2024.
The EU expresses its deep concern at this setback to the rule of law, in particular when executions are carried out in a country that has so far chosen to maintain a moratorium on the death penalty.
On August 8, the Kinshasa/Gombe Military Court sentenced 26 people to death for war crimes, participation in a rebel movement and treason.
On the same day, the EU adds, the Kinshasa-Gombe High Court sentenced to death 6 members of the Force du Progrès, a group affiliated with the Union pour la Démocratie et le Progrès Social party, on charges including criminal conspiracy and attempted murder.
Following the military tribunal’s decision, the Minister of State, Minister of Justice and Keeper of the Seals, Constant Mutamba, promised to take action to ensure that the death penalty was respected against the various defendants.
In both cases, the convicts have five days to appeal.
